METHUEN, MA –
On 12/24/18, Valley Towing submitted a Motion to Dismiss the Class-Action Lawsuit filed against them by Matt Kady in August of 2018. They allege in their Motion that Matt kady “forged the clean up fee” and has “Dirty Hands”. Matt Kady’s Lawyers also submitted their opposition.

After a review of the pleadings, it is clear this Motion to Dismiss will be DENIED in its entirety, and Valley Towing will be facing Discovery and Depositions as they proceed towards a fall 2019 pre-trial conference.

According to Matt Kady’s Lawyers, Valley Towing is using Recycled, Failed, and Rejected arguments from similar cases recently argued in Suffolk and Middlesex Courts over the past couple of years.

It appears these towing litigation cases are a quickly evolving area of law in Massachusetts.  This case is being argued by the same lawyers who are making the winning arguments in the other cases. See Silva v. Todisco Services, Inc. (Lawyers Weekly No. 09-027-18
